SESSION RULES
1. All players must be 12 years and over. Players aged between 12 and 17 years old must be accompanied by a responsible adult. Attendees under the age of 12 are not permitted in the darts alley.
2. Sessions are subject to a minimum of 2 players during off peak times and a minimum of 4 Players during peak times (Friday from 5pm, all day Saturday and Sunday) .
3. Sessions are limited to a maximum play time of 45 minutes.
4. Please be prompt in arriving for your Session. We will hold your darts alley for ten minutes from your Session start time thereafter we may open the alley for other players. If you are running late, please let us know and we will do our best to accommodate you.
5. Food and drink are not included as part of the Session booking and must be purchased separately. Only food and drink purchase onsite may be consumed in this Venue.
GUEST OBLIGATIONS
1. The Organiser and all Players and Attendees shall:
a. ensure that Players and Attendees do not commit any nuisance, disturbance or infringement and comply with all reasonable requests of Venue staff;
b. only use the darts provided by us. Our game is designed to work with the specific darts provided only. External darts are not permitted for health and safety reasons.
c. ensure that no children under 12 are in the darts alley. Players between 12 and 17 years old must be accompanied by a responsible adult;
d. drink and play responsibly. We reserve the right to refuse entry or service to, or to remove, any Player or Attendee whose behaviour puts at risk the enjoyment and safety of staff or other Players and Attendees;
e. ensure that no damage is caused to our alleys, equipment or other property. Where any damage is caused, the Organiser will be required to pay for the damage.
f. ensure that where Players and Attendees bring their own possessions into the Venue, they are supervised responsibly. The Venue nor any of its staff, agents or partners will be responsible for any loss or damage caused to such possessions unless caused by the deliberate acts or omissions, or negligence, of the Venue and save to the extent that such responsibility cannot be excluded by law;
g. report any accidents, injuries or damage to a member of Venue staff immediately;
h. comply with all security, fire and other regulations relating to the Venue premises and not commit any illegal acts;
i. not carry out any betting, gaming or auction activity on the Venue premises;
j. not use the Venue’s name or logo, the Hightales name or logo or the Greene King name or logo except in such form as may be provided by the Venue.
2. By attending a Session, you voluntarily assume all risks and danger in relation to the Session, and neither the Venue nor any of its staff, agents or partners will be responsible for any loss or damage caused unless caused by the deliberate acts or omissions, or negligence, of the Venue and save to the extent that such responsibility cannot be excluded by law.
SESSION TERMS AND CONDITIONS
1. Definitions
1.1. "us" is Greene King Brewing and Retailing Limited of Westgate Brewery, Bury St Edmunds, Suffolk, IP33 1QT.
1.2. "You" or the “Organiser" means the person who makes the Session booking and enters into this contract.
1.3. "Venue" is the premises which is part of the Greene King group and will be holding the Session.
1.4. "Session" is the timeslot that you book at the Venue to play darts.
1.5. “Players” means all those 12 years old and over who will be playing in the Session.
1.6. "Attendees" means all those who attend a Session.
2. BASIS OF CONTRACT
2.1. These terms and conditions apply to the Session booking to the exclusion of any other terms that the Organiser seeks to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.
2.2. A request to book a Session constitutes an offer by the Organiser which shall only be deemed to be accepted when Greene King issues its written acceptance of the request, at which point a contract shall come into existence.
2.3. The contract constitutes the entire agreement between the parties. The Organiser acknowledges that it has not relied on any statement, promise or representation made or given by us or on behalf of the Venue which is not set out in the contract.
2.4. Any Session booking request made by someone reasonably purporting to represent the Organiser shall be binding on that Organiser.
3. CANCELLATION
3.1. In the event of cancellation by the Organiser, you will not receive a refund of the Session booking deposit as all Session booking deposits are non-refundable.
3.2. We may cancel the booking:
3.2.1. if any part of the Venue premises is closed due to fire, dispute with employees, alteration, decoration or by order of any Public authority; or
3.2.2. if the Organiser fails to adhere to any of these terms and conditions.
3.3. In the event of cancellation by us under paragraph 3.2.1, we will refund any payment made. We will have no further liability to the Organiser.
4. CHANGING THE SESSION BOOKING
4.1. If the Organiser wishes to change any details of the Session booking, the Organiser should contact the relevant Venue with details of the requested change. Where we are able to fulfil your request we will do so but we cannot guarantee that any changes can be made.
5. RESALE
5.1. Session bookings may not be re-sold or transferred. Any attempt to do so may result in cancellation of the Session without refund, and the holder of a re-sold or transferred Session may be refused entry or required to leave the Venue.
6. PAYMENT AND CREDIT
6.1. The full amount is to be paid at the time of booking. Please note that this deposit is non-refundable.
7. LIABILITY AND INSURANCE
7.1. We will not be liable to Organisers or any Attendees for loss of or damage to property except where and to the extent that such loss or damage is caused directly and wholly by the deliberate act or omission or by the negligence of the Venue or its employees or agents save to the extent that such responsibility cannot be excluded by law. All personal belongings which the Organiser and any Attendees leave in the Venue will be left at their own risk.
7.2. The Organiser assumes responsibility for any and all damage caused by them or any of the Players and/or Attendees attending the Session.
7.3. Nothing in these terms and conditions shall limit liability for death or personal injury caused by our negligence but the Organiser agrees that consequential loss or damage is not a likely result of our failure to hold the Session.
8. DATA PROCESSING
8.1. Any data taken for the Session booking is subject to Greene King’s data and privacy policies https://www.greeneking.co.uk/privacy. Data taken when players register on the 501 darts system, including images and personal details are deleted immediately and not stored permanently.
9. GOVERNING LAW AND THIRD PARTIES
9.1. These terms shall be governed by English law and dealt with exclusively, if necessary, by the English courts.
